Man charged over fatal collision on outskirts of Limerick city

A MAN has appeared in court charged with dangerous driving causing the death of married father-of-two and local GAA coach.

Joseph Smyth, aged 27, of Cathedral Court, Ennis, County Clare appeared before Ennis District Court after he was charged with dangerous driving causing the death of Gerard Gunning near Meelick on the outskirts of Limerick city on March 24 last year.

Mr Gunning was a passenger in the 132-registered vehicle that Mr Smyth was allegedly driving at the time.

In evidence of arrest, charge and caution, Garda John Marsh said that he met with Mr Smyth by appointment before the court sitting and charged him.

Garda Marsh said Mr Smyth made no reply to charge.

Sergeant Louis Moloney told Judge Alec Gabbett that directions have been received from the DPP and that the case is to be dealt with on indictment at the circuit court.

Sgt Moloney said that a Book of Evidence will be required and he requested an adjournment to facilitate its preparation.

The court was told bail conditions have been agreed including that Mr Smyth surrenders his passport and agrees not to apply for a new one.

Citing the severity of the charge, solicitor for apprentice plumber, Smyth, Darach McCarthy, made an application for legal aid.

The application was granted by Judge Gabbett who remanded Mr Smyth on bail to appear before court again on September 20.

The deceased, who was aged 47 and was from Kilbane, Broadford, County Clare is survived by his wife, Jennifer and his sons, Dillon and Adam.
