Complaints lodged over Rosanna Davison's 'misleading' Instagram post

Complaints have been made to the Advertising Standards Authority regarding an Instagram post by Rosanna Davison in which she didn't include an advertising label.

The influencer posted to her Instagram account showcasing leisurewear from the brand Human Collective who she has a partnership with.

Davison has previously shared posts promoting the brand, however one post in particular has received some backlash due to her not labelling it as a #Ad.

The post in dispute was of Davison showing one of Human Collective's crew-neck sweatshirts and bike shorts alongside the announcement of a 20% sale.  

Although she did include "Wearehumancollective.com" at the end of the post, the complaints still considered it to be misleading, claiming the "influencer had not indicated their relationship with the brand."

In response to the complaints, Rosanna Davison and Human Collective agreed that it was a "genuine oversight."

Human Collective assured that going forward "all collaborative posts with them would be marked as 'Paid Partnership'. They considered this would prevent similar errors from arising in the future."

Davison also reassured that it would not happen again, "as they were always clear in relation to identifying advertising material."

The Complaints Committee concluded that "the advertising content had not included a primary identification label, and therefore had not been correctly identified as advertising material, and as such, likely to mislead consumers about the nature of the content."

The committee stated that the post was indeed in breach of Sections 3.31, 3.32, 4.1, and 4.4 of the advertising Code requirements.

They have advised Davison and Human Collective that any future advertising should "not appear in the same format again."
