THE State has appealed a decision made in a pretrial hearing in relation to the case of a retired superintendent and four gardaí who are charged with attempting to pervert the course of justice in relation to penalty point notices.
At the Court of Appeal today, an application was made by the Director of Public Prosecutions relating to matters raised at a preliminary trial hearing in 2023.
The respondents in this matter are retired Garda Superintendent Edmond “Eamon” O’Neill (56), formerly of Limerick Garda Division, Sergeant Annemarie Hassett (39) of Kerry Division, Sergeant Michelle Leahy (47) and Garda Thomas McGlinchey (51), both of the Limerick Division and Garda Colm Geary (36) of Clare Division.

All of the respondents are charged with more than 40 counts of attempting to pervert the course of justice.
The 42 total charges relate to events that allegedly occurred on dates between October 9, 2016, and September 6, 2019.
The charges follow a lengthy investigation by the Garda National Bureau of Criminal Investigation (GNBCI).
It is alleged the five accused attempted to pervert the course of justice in relation to fixed charge penalty notices.
