Owners of Limerick fuel depot agree to remove it

THE owners of a unauthorised fuel yard on the south side of Limerick city have agreed to remove it from its current location after Limerick City Council initiated legal action.

At Limerick Court, Judge Eugene O’Kelly was told an enforcement notice was served on Raymond Bennett and Anthony Bennett Junior on January 8, last.

The notice, the court heard, required the defendants to remove a portacabin and associated fuel yard from the site, which is located across the road from Roxboro Road garda station by February 6.

Solicitor Ger Reidy, representing the local authority, said while the notice has not yet been complied with, discussions have taken place between the parties.

He said the council was willing to adjourn the matter for several months, if certain undertakings were given to the court.

In his direct evidence, Raymond Bennett give a sworn undertaking to remove the fuel yard and compound by May 2, next and to remove the portacabin, which is being used as an office by June 6, next.

Mr Bennett confirmed he was giving the undertaking on behalf of himself and his brother and he acknowledged he will be in contempt of court, if the works are not carried out.

The judge adjourned the matter until June 6, next for review.
