Judge Patrcia Harney commented: 'It just does appear there were large tranches of time where nothing happened'
A MAN living in Moyross has received a strikeout for a section three possession of drugs charge.
Garda investigations into the case of Noel Stanners, aged 33, of Delmege Park, Moyross, were subject to an “unconscionable and prejudicial” delay, according to Judge Patricia Harney.
Garda Mark Ryan of Mayorstone garda station gave evidence that on September 7, 2021 two men were searched at Delmege Park, Moyross.
Garda Ryan alleged that a “large amount of drugs” were found in a horse box which was parked at the location.

The garda went on to explain that all of the gardaí involved in the investigation (other than himself) have since left An Garda Síochána for reasons unrelated to the case.
Judge Patrcia Harney commented: “It just does appear there were large tranches of time where nothing happened”
The judge added that she was not happy with the delay in progressing the garda investigation.
“The delay is unconscionable and prejudicial to Mr Stanners,” she said.
Having considered matters further and given the consequences, Judge Harney directed that the case brought against Mr Stanners be struck out.
