Kilmallock Court heard that the defendant had four previous convictions for no insurance
A JUDGE said a Limerick man prosecuted for his fifth no insurance offence has “no regard for court orders”.
Patrick Mulvihill, aged 35, of Forest View, Kilfinane pleaded guilty to no NCT, non display of tax disc, no driving licence and no insurance. He was stopped by Garda Niall McInerney on the Main Street of Kilfinane on January 21, 2017.
Kilmallock Court heard that the defendant had four previous convictions for no insurance.
Brendan Gill, solicitor for Mr Mulvihill, he hasn’t come to garda attention since the last incident.
“His partner left the jurisdiction. He is now the sole carer of three children,” said Mr Gill.
Judge Marian O’Leary said Mr Mulvihill was disqualified from driving at the time.
“He has no regard for court orders,” said Judge O’Leary.
Mr Gill said his client will have no opportunity to drive as he has no vehicle.
“His partner had the vehicle. The penny has dropped. He is caring for small children,” said Mr Gill.
Judge O’Leary handed down a four month suspended prison sentence, six year disqualification and a €500 fine for driving without insurance. Mr Mulvihill was also fined €100 for no driving licence.
The other two matters were taken into consideration.
