THE UNIVERSITY of Limerick has made a “possible fraud” referral to gardai this week over the ‘“Rhebogue acquisition” which saw the institution overpay by €5.2m for 20 homes.

Limerick Live understands that the view has been formed that “in all the circumstances a referral to An Garda Síochána under Section 19 of the Criminal Justice Act 2011 is appropriate”.

It is understood that “such a referral” was made on Tuesday of this week.

According to the garda website, Section 19 Criminal Justice Act 2011 “places a legal obligation on you to report to An Garda Síochána, information relating to possible frauds which you know or believe might prevent the fraud being committed, or secure the apprehension prosecution or conviction of a person involved in fraudulent activity.” It reads, “You should report this information to your local garda station”.

Limerick Live contacted the Garda Press Office regarding the referral made to gardai by University  of Limerick this week.

A garda spokesperson said An Garda Síochána does not comment on, confirm or deny correspondence received or not from any named individuals or entities.

“In general, any correspondence received by An Garda Síochána are first assessed to see if they meet the threshold for a potential breach of criminal law before a formal criminal investigation would be commenced.

“There is no criminal investigation as suggested in your enquiry at this time,” said the garda spokesperson.

A University of Limerick spokesperson declined to comment.
