Limerick Court heard that while the boy was wearing a helmet, the go-kart was not fitted with a seat belt
A YOUNG boy who sustained minor injuries when his go-kart hit a crash barrier at Delta Karting, Ballysimon Road has been awarded €10,000 in damages.
Through his mother, the now 14-year-old sued for damages arising from an incident on August 23, 2015.
Court papers claimed the boy “somersaulted” out of the kart and landed on his neck before rolling onto his stomach. While he was wearing a helmet, the go-kart was not fitted with a seat belt.
Judge Sean O’Donnabhain was told liability would have been an issue had the case gone to hearing as there were a “lot of liability issues” such as the assumption of risk given the nature of the activity involved.
The boy attended the ED department at UHL following the incident and was treated for soft-tissue injuries to his spine.
He also injured one of his index fingers and his lip but has made a full recovery.
The boy’s father confirmed he was aware of the potential issues in the case and that he was satisfied with the settlement offer.
Noting this, Judge O’Donnabhain said he had “no hesitation” in approving the offer before the court.
