A defendant told a Bruff-based garda, “F**k you and your charges”, Kilmallock Court heard

A DEFENDANT told a Limerick-based garda, “F**k you and your charges”, Kilmallock Court heard.

Bruff-based Garda Brendan Daly gave evidence of arresting, charging and cautioning Nigel Sheehan, aged 38, of Sheares Street, Kilmallock.

Garda Daly said when he charged Mr Sheehan with failing to obey garda instructions to leave the vicinity of Sheares Street, he replied: “It will only be a fine.”

When Garda Daly put it to him that he engaged in threatening / abusive / insulting behaviour, Mr Sheehan said: “F**k you and your charges.”

Garda Daly said the accused made no reply to the third charge of intoxication.

All the offences are alleged to have happened in the early hours of Tuesday, April 10, in Sheares Street, Kilmallock.

Garda Daly said there was no State objection to bail subject to a number of conditions.

Mr Sheehan is to have no contact with a named individual; stay away from a certain address in Kilmallock; obey a curfew of 11pm to 7am; be of good behaviour and stay alcohol and drug free in public.

Michael O’Donnell, solicitor for Mr Sheehan, made a disclosure order and applied for legal aid.

The case was adjourned until June 12 in Kilmallock Court.
