Limerick man sentenced to four months in prison, but shouts 'I want 12 months!'

A CROOM man with 142 previous convictions had to be physically restrained by gardai and shouted at the judge who sentenced him to four months in prison: "Ms Halloran! Ms Halloran! I want 12 months!"

Michael Whelan, of Kylefea, Croom, created such a disturbance when appearing before Judge Mary O'Halloran at Rathkeale Court, for theft and public order offences, that he had to be forcibly removed from the courthouse in Newcastle West on several occasions last Thursday before his case was heard.

He shouted "Tiocfaidh r l", "Up the RA" and "Get these f****** cuffs off me", before shouting directly to the judge that he wanted 12 months in jail. Supt Joe Roe told the court that Mr Whelan was "intoxicated in the vicinity of the court" after suspected solvent abuse that morning.

When his case was heard, Mr Whelan was convicted of stealing two flagons of cider worth €5.95 and a packet of razor blades worth €21.58 from the Spar shop in Croom on February 14 and February 21 respectively. He was also convicted for causing a public disturbance at Kylefea on February 21.

Supt Roe said that Mr Whelan, who has only just been released from prison, was a "tragic case". Judge O'Halloran expressed regret that she has had to "reprimand him on a continuous basis".

In January, Mr Whelan was jailed for a total of two months at Rathkeale Court after he assaulted two gardai, stripped down to his underwear and behaved inappropriately in front of a female garda, and acted threateningly and abusively in public last November and December.

The court previously heard that on November 22 Mr Whelan was "extremely intoxicated" while at a takeaway on Main Street, Croom and subsequently punched and kicked two gardai at Askeaton Garda Station after he was arrested.

On December 12 last, Mr Whelan again kicked two gardai after he called to a number of pharmacies in the town asking for prescriptions. He was arrested and brought to Henry Street Garda Station, where he stripped off and behaved in an inappropriate manner towards to a female garda.

At last week's court sitting, Judge O'Halloran sentenced Mr Whelan to a total of four months in prison for his offences on February 14 and 21.
