‘Dangerous dog’ to be put down after appeal is struck out

AN appeal against the decision to destroy a ‘dangerous dog’ which gardai successfully applied to have put down was struck out when the owner of the dog failed to attend the appeal
During a hearing at Limerick Court last November, Judge Eamon O’Brien ordered the destruction of the Alsatian dog after he granted an application which was brought under the provisions of the Control of Dogs Act.
The dog, which was seized from a house in Ballinacaurra Weston last October has been detained at a dog pound since the court decision.
Previously, Limerick Court was told the Alsatian, which is owned by a nine-year-old boy whose father is a convicted criminal, bit Garda Donal Walsh twice as he was on routine patrol in Ballinacurra Weston on September 22, last.
Garda Walsh, who was out sick for three weeks after the incident, said the dog was not on a lead and that it was not wearing a muzzle when it attacked him in broad daylight,
During the application, a senior official at Limerick City Council said the local authority had received numerous complaints’ in relation to the dog over the summer.
When the appeal against that decision was called at Limerick Circuit Court, State Solicitor Michael Murray asked that it be struck out as neither the owner of the dog or his mother were present in court.
Judge James O’Donohoe granted the application paving the way for the dog to be put down by the authories.
