Corbally attack accused is refused bail after objection by gardai
A TEENAGER charged in connection with a frenzied attack on a 16-year-old boy in Corbally has been refused bail after it was revealed that the HSE does not have a suitable facility to accommodate him.
The victim of the assault who was kicked, beaten and stamped upon in the forecourt of Applegreen filling station on Friday night remains in a critical condition at the Mid Western Regional Hospital.
A 17-year-old boy who is charged with assaulting the teenager causing him serious harm appeared before the Children's Court yesterday afternoon where Detective Garda Andrew Lacey objected to bail being granted given the serious nature of the charge.
Solicitor Darach McCarthy made an application for bail on behalf of the accused boy who was taken into voluntary care by the HSE last Friday prior to the alleged attack.
The solicitor asked a HSE official in court if there was any facility, locally or nationally, where the 17-year-old could be placed if he was granted bail.
The official said that the HSE had been asked to investigate the availability of suitable accommodation for the accused boy following his first appearance at a special court sitting on Sunday.
He said, however, that there was no facility that would meet his needs. Mr McCarthy asked if his client's needs would be better served at a detention centre or at a HSE special care unit.
"My client more so than ever needs the assistance of the HSE while he has charges pending."
The HSE official said is criminal charges are pending against a young person, the charges must be dealt with before a person can enter a special care unit.
Judge Eamon O'Brien refused bail and remanded the 17-year-old in detention to August 18 by consent.
