A MOYROSS man who is charged in connection with a major drugs haul on the northside of the city last year has been granted bail at Limerick District Court.
Heroin with a street value of €145,000 was seized in Castle Park, Ballygrennan, Co Clare on October 15, 2010.
John McCarthy of 87 Cliona Park, Moyross faces three charges under the Misuse of Drugs Act including possession of heroin, possession of the drug for sale or supply, and possession of heroin in excess of €13,000 for sale or supply.
At Limerick District Court yesterday, Garda David McGrath gave evidence of arresting the 40-year-old yesterday morning at his Moyross home and bringing him to Henry Street Garda Station where he was charged in relation to the heroin seizure. Garda McGrath said Mr McCarthy made no reply to the charges after caution.
Solicitor Sarah Ryan made an application for bail on behalf of her client. Detective Sergeant Alan Cullen took to the stand and objected to bail being granted to the accused given “the nature and seriousness” of the charges against the defendant.
Dressed in a black hoodie and a black jacket, Mr McCarthy did not speak during the bail hearing.
Judge Tom O’Donnell said the defendant faced “very, very serious charges on the face of it”.
The judge said he was also conscious that the DPP has given directions that this matter should proceed by indictment.
He said he had to deal with the charges before him, and fixed bail on Mr McCarthy’s own bond of €500 and an independent surety of €10,000.
If Mr McCarthy achieves bail, the accused man must abide by bail conditions which include residing at his home in Cliona Park, surrendering his passport, abiding by a nightly curfew, and signing on daily at Mayorstone Garda Station.
He was remanded in custody with consent to bail and is due before the court again on Tuesday, February 22.
Two men who were previously charged in connection with the same heroin haul, were further charged with possession of drugs in excess of €13,000 for sale or supply.
There was no garda objection to bail being extended to cover the two new charges.
Adam Llewllyn, 18, with an address at Craeval Park, Moyross and James O’Keeffe, 20, of Moylish Crescent, Ballynanty were further remanded in custody with consent to bail to appear before the court again next Tuesday, February 22.
