Solicitor Michael O'Donnell: Application for legal aid granted

A NEWCASTLE West man became aggressive towards staff at a local licensed premises while he was “extremely intoxicated”, the local court has heard.

Seamus O’Mahony, aged 29, of Daarwood, Newcastle West, pleaded guilty to being intoxicated and abusive in public at Bridge Street, Newcastle West on December 16, 2012.

Speaking at the local court last Friday, Supt Dan Flavin said that at 12.45am gardai received a call from the premises where Mr O’Mahony had been drinking.

On arriving at the scene, gardai found that the accused was “extremely intoxicated and aggressive” and was “shouting at staff”.

When gardai attempted to deal with the situation, the accused then “became threatening to gardai” as well, and was arrested.

The court heard that the accused has nine previous convictions, including possession of a knife, refusing to give a breath sample in connection with suspected drunk driving, criminal damage, failing to give a name or address to gardai and other public order offences dating back to 2006.

Solicitor Michael O’Donnell, defending, admitted that the accused’s behaviour was “obviously out of order”.

The court heard that Mr O’Mahony is an unemployed stone mason. Mr O’Donnell said that the accused plans to emigrate to Australia, where his brother is living.

When asked by Judge Mary Larkin if the accused has a drink problem, Mr O’Donnell replied “a small problem alright”, and added that an alcohol awareness programme “would be beneficial to him”.

Judge Larkin placed Mr O’Mahony on a probation bond for twelve months.

She adjourned the case until May 10, when the terms of his probation will be finalised.
