Patients can still claim over hip recall, says solicitor

A SOLICITOR acting for Limerick patients who had DePuy hip replacements implanted before a worldwide product recall in 2010 has said it is not too late to make a claim.
Peter McDonnell, a medical litigation specialist, is hosting a meeting at the Clarion Hotel next week on how to take legal action against the medical devices giant.
The devices were recalled worldwide after doctors reported high failure rates and warned of organ complications resulting from the leakage of cobalt and chromium. More than 3,500 Irish patients had devices implanted before the recall.
Mr McDonnell told the Leader that while DePuy had agreed to cover the costs of diagnostic tests, corrective surgery and certain expenses, it had not accepted liability for compensation and loss of earnings for people with lasting health damage.
The solicitor is representing up to 50 Limerick people who had surgery in the Bon Secours in Cork and Tralee; St Mary’s, Cork; Kilcreene Hospital, Kilkenny; and Whitfield Clinic in Waterford. Others he had spoken to seemed to believe that the statute of limitations now prevented them from making a claim.
“Many patients whom I have spoken with throughout Ireland are under the impression that it is too late for them to submit a claim against DePuy. This, however, is not the case,” he said.
“Not only has the health and well-being of thousands of patients already been adversely affected by this appalling corporate and medical catastrophe but their lives are being subjected to further trauma as a result of the myriad of misinformation that has been emanating since the recall was first announced.”
The free DePuy hip recall information meeting, hosted by Peter McDonnell & Associates, will commence at 2pm on Wednesday, March 20 in The Clarion Hotel.
