Man exposed himself to females on their morning jog
A PROBATION report is to be carried out on a man who exposed himself on two occasions to two females who were out for a morning jog.
Timothy Dwyer, aged 37, of Riverview, Kilmallock was before the local court charged with exposing himself on a public roadway to two female pedestrians in such a way as to offend modesty (public indecency) on February 12 last at Mortalstown, Ardpatrick, Kilmallock.
Garda Christopher Cowan told the court that at approximately 10.30 in the morning two females were out running on a public road when they were passed by Timothy Dwyer who stopped his motorbike and pulled in and went on all fours and exposed himself. The court heard that the females continued to run and Dwyer passed them by and again exposed himself.
The court heard that Dwyer had six previous convictions for offences including theft. Defence solicitor, Brendan Gill, said the vast majority of his client’s previous convictions dated back to 2001.
Mr Gill said Dwyer had been working for a food company but had lost that position.
The court heard that Dwyer suffers from severe schizophrenia. Mr Gill said that his client informed him that on the date of the offence, he had not had any sleep for up to 48 hours.
“He had run out of his medication and this might explain what occurred,” said Mr Gill.
“He is someone who is very vulnerable,” said Mr Gill who added that he had spoken to the superintendent and it was agreed that Dwyer is someone who could benefit from some form of intervention.
Judge Mary Larkin made an order to convict and said she would adjourn a decision on a penalty until a probation report was completed. A probation report is to be before the March court.
Mr Gill asked to be assigned in relation to the matter and said his client is currently on disability.
