Limerick women were involved in ‘cat fight’ on busy street
Solictor Ted McCarthy told Limerick Court his clients did set out to rob the injured party of her mobile phone
TWO women who were involved in a “cat fight” during broad daylight have been bound to the peace for 12 months.
Tracey Moran, aged, 30, of Johnsgate Village and Carmel Duggan, aged 28, of Thomond House, Thomondgate each pleaded guilty to a robbery charge relating to an incident on February 22, 2012.
Limerick Court was told the defendants were involved in an altercation on the street with another woman shortly before 3pm.
Insp Seamus Nolan said the injured party was verbally abused by the defendants as she walked on the street.
He said a physical altercation following during which Ms Duggan held the injured party on the ground.
He said Ms Moran took the injured party’s mobile phone before the pair left the scene.
The victim sustained minor scrapes and scratches and Insp Nolan said the phone was later recovered when gardai called to Ms Moran’s home.
Solicitor Ted McCarthy said Ms Duggan, who has 19 previous convictions, knew the injured party as they both have children with the same father.
He said as a result there was “animosity and disharmony” between the pair and that a “two-way shouting match” had broken out when they encountered each other on William Street.
“There was a cat fight between the two of them,” he said adding that Ms Moran, who has six previous convictions, was not involved in the fight, which lasted for several minutes.
“She was told stay out of it,” said Mr McCarthy who conceded she had picked up the mobile phone when it was dropped by the injured party.
Mr McCarthy submitted to the court that neither of his clients had set out to rob the injured party and he urged the judge to take into account the background to the incident.
He added that both women under the influence of intoxicants at the time but that they have not been in any trouble since.
Judge Eugene O’Kelly noted that a year has pased since the incident, which he commented was “almost bordering on a domestic situation”.
Applying the Probation Act, he ordered each of the defendants to keep the peace for the next twelve months.
In doing so, he said both Ms Duggan and Ms Moran would be “well advised” to stay away from the injured party during that time.
