Drinks to excess: Solicitor John Herbert said his client is 'not an habitual drinker'
A SINGLE father, who pleaded guilty to driving while almost three times the legal alcohol limit was disqualified from driving for eight years.
Wesley Carrier, aged 36, of Clark Avenue, Janesboro, was also warned if he gets into any trouble over the next two years he will go to prison.
At Limerick Court, Garda Philip Ellard of the divisional traffic corps, said he was dealing with an incident on Roches Street in the city centre at 1.30am on April 8, 2012 when he heard a loud bang.
Upon further investigation, he discovered Carrier, who was in an intoxicated state, sitting in the driver seat of a car, which had knocked over a traffic bollard on the footpath as he was reversing in an attempt to pull out of the parking space.
Insp Luke Conlon said the defendant, who has a teenage daughter, was disqualified from driving at the time as he had previously been convicted of driving without insurance. He has two convictions for drink driving dating back ten years.
Solicitor John Herbert said his client was “not an habitual drinker” but that “when he breaks out, he drinks to excess”.
Mr Herbert said he client was aware of the “vista he faces” but he urged the court not impose a custodial sentence.
Judge Eugene O’Kelly said Carrier has shown “complete contempt” for the earlier court order” and he asked? “What would have happened if he had knocked down a pedestrian instead of a bollard, the situation is dreadful.”
Carrier said he has not consumed alcohol since the incident and he told the court he was disgusted with himself.
“It was just ridiculous what I done and I regret it and it won’t happen again,” he said.
Imposing sentence, Judge O’Kelly said the court was not going to tolerate such behaviour in future.
However, in the circumstances he said he would not impose an immediate custodial sentence.
He disqualified Carrier from driving for eight years and he imposed a five month prison sentence, which he suspended for two years.
Carrier, who was not inured on the night, was also fined €500 for driving without a driving licence.
