Brothers ordered to stay away from family home

TWO elderly brothers have been ordered not to enter their original family home after their sister was granted a court injunction.

Theresa Wade initiated proceedings against Matthew and Michael Kennedy due to concerns she has over animals being grazed and illegal dumping at the cottage which is located at Lackabeg, Cappamore.

Limerick Circuit Court was told that Mrs Wade has owned the property since 1994 and that her brothers are no longer living there.

The property was originally owned by her parents, Patrick (Snr) and Mary Kennedy, who are both deceased.

John O’Sullivan BL, representing the plaintiff, told the court his client was also entitled to seek the removal of the rubbish as well as damages in the case but that she would not be doing so.

Judge Carroll Moran (pictured) informed the defendants, who said they could not afford a solicitor, that he was granting the injunction as they “did not appear” to have a defence.

After the ruling was handed down, Patrick Kennedy - a brother of the two defendants - said: “We came here for justice today and we didn’t get any.”
