Bail granted at Limerick Court in ‘motoring matter’

A MOTORIST who was arrested on suspicion of drink driving over the Christmas period was granted bail on condition he lives at his girlfriend’s home in the Castletroy area of the city.
Martin Wynn, aged 37, who has addresses in Murroe, Castletroy and Newport is accused of refusing to give a sample of his breath to gardai following his arrest on December 27, last.
The offence is alleged to have happened in the early hours of December 28, last.
Garda Edel Crowley told a vacation sitting of Limerick Court she arrested the defendant at Murroe Wood, Murroe at 11.30pm the previous night.
She said he was taken to Henry Street garda station where he was later charged under the provisions of the Road Traffic Act.
Garda Crowley said the defendant replied: “Can I get a glass of water and a fag love,” when he was formally charged at the garda station.
Insp Seamus Ruane formally opposed a bail application saying he had concerns as to the address of the accused.
He said the address he had given gardai following his arrest was false and he claimed at one point Wynn had also told gardai he lives in his car.
Solicitor John Herbert said his client would undertake to live with his girlfriend at her home in the Briarfields estate in Castletroy.
Insp Ruane said he didn’t believe the defendant lived at that address and he said it had not been mentioned by him prior to his court appearance.
Following a short adjournment to allow further enquiries to be conducted, Wynne’s girlfriend gave evidence that he could stay at her home.
“He is welcome to stay there,” she told the court.
Insp Ruane reiterated his concerns saying that Wynn and his girlfriend had a “loose arrangement” and that her home was “not a permanent address” for him.
Insp Ruane said gardai had concerns Wynn was a flight risk and he claimed he had “done nothing but frustrate the prosecution,” since his arrest.
Judge Aeneas McCarthy granted bail but he ordered that Wynn must sign on daily at Henry Street garda station as a condition of his bail.
The judge ordered him to live at his girlfriend’s address but he refused to impose a curfew saying it was “road traffic matter”.
Wynn is due to appear before the court again on January 8, next.
