91-year-old Limerick man is charged with assault

A COUNTY Limerick man aged in his nineties has appeared before a court charged with obstructing a garda in a nursing home.

Niall O’Mahony, aged 91, of Ardkilmartin, Kilmallock, is also alleged to have been physically and verbally abusive to a garda and staff at Maria Goretti nursing home on the same date of Monday, February 25.

Mr O’Mahony is also charged with assault at the nursing home, which is located in Kilmallock, on Thursday, January 10.

Mr O’Mahony was in Kilmallock Court and Judge Mary Larkin told him that the gardai have brought charges against him.

Robin Lee, solicitor, said Mr O’Mahony was an elderly man and eligible for free legal aid.

“I want you to have a solicitor. I’m giving you free legal aid,” said Judge Larkin to Mr O’Mahony.

After Mr Lee had consulted with his client, he said they could proceed with the case and indicated a plea of guilty.

Superintendent Alan Cunningham applied for a short adjournment as files had been sent to the DPP.

Judge Larkin fixed bail on the defendant’s own bond of €300.

Supt Cunningham applied for two bail conditions.

“That Mr O’Mahony confine visits to Maria Goretti nursing home to twice per day,” said Supt Cunningham.

Mr Lee explained to the judge that Mr O’Mahony lives very close to the nursing home and receives his principal meal of the day there.

Supt Cunningham also asked as a condition for bail that Mr O’Mahony, “not interfere with any of the staff in the nursing home and be of good behaviour while at the nursing home”.

Mr Lee said his client would adhere to the conditions.

Judge Larkin granted bail to the accused and adjourned the case until next Friday, March 15.
